Bernalillo County Sheriff John Allen said his deputies responded to a report from a store clerk at a gas station at about 7 a.m. local time.

Deputies established a perimeter in a nearby neighborhood after they spotted Smith walking and a foot pursuit ensued, Allen told reporters Sunday.

“Shots were fired, some shots strike Smith,” Allen said. “We don’t know the amount right now or how many, that is still under investigation. But Smith was then taken into custody without further incident.”

Smith is currently at a hospital being treated for injuries under the guard of law enforcement, according to Allen.
